1. The service. Hometiko provides a multi-tenant platform that hosts your agency's public website, content management system (CMS), customer relationship management tools (CRM), and AI features (chatbot, semantic matching, listing assistant). Your subscription covers hosting, maintenance, and updates.

2. Your account. You must provide accurate agency information and keep credentials secure. You are responsible for content published under your tenant, including listing accuracy and the legal right to use uploaded photos and materials.

3. Your content stays yours. Listings, leads, media, and text you create remain your property. You grant Hometiko a limited license to host, process, translate, and display this content solely to operate the service. You may export all data at any time.

4. AI features. AI-generated descriptions, translations, and chat replies are drafts produced by machine-learning models. You are responsible for reviewing AI output before publication. AI usage is metered per plan; unused actions do not roll over.

5. Billing. Paid plans start with a 14-day free trial. A payment method is taken at signup but nothing is charged until the trial ends. Subscriptions are then billed monthly or yearly in advance through our Merchant of Record, which collects and remits applicable VAT, KDV, or sales tax and issues invoices. Fee changes are announced 30 days in advance. Cancellation and refunds are covered in the next section.

6. Acceptable use. No unlawful listings, discriminatory advertising, scraping of other tenants, or resale of the service without written agreement. We may suspend tenants that endanger platform security or violate law after notice where feasible.

7. Availability & liability. We target 99.9% monthly uptime. The service is provided “as is”; to the extent permitted by law, our aggregate liability is capped at the fees paid in the twelve months preceding the claim. Nothing limits liability for intent or gross negligence.

8. Termination & export. On termination you have 30 days to export listings, leads, and content in machine-readable formats, after which tenant data is deleted per our retention schedule.

9. Governing law. This agreement is governed by Turkish law, with the courts of Alanya, Antalya having jurisdiction. The purchase transaction itself is between you and our Merchant of Record and runs under its terms, shown at checkout. Mandatory consumer protections of your own country of residence remain unaffected in either case.

The trial is the refund. Every paid plan starts with 14 days free. A card is collected at signup, but nothing is charged until the trial ends — so you can run the whole product on your own listings and decide before any money moves.

Cancelling. Cancel at any time from your dashboard, in one click, with no notice period and no cancellation fee. Cancel before the trial ends and you are never charged at all.

After a payment. Payments already taken are not refunded. Your plan stops renewing and access continues to the end of the period you have paid for; you keep 30 days after that to export your listings, leads and content.

Exceptions. If we bill you in error, or the service is unavailable for a sustained period through our fault, contact us and we will put it right. Statutory rights that cannot be waived in your country of residence are unaffected by anything above.

How to ask. Billing questions go to billing@hometiko.com, or to our Merchant of Record directly using the link on your receipt — it processed the payment and issues the invoice.

1. Two roles. For agency accounts, Hometiko is the controller of your registration and billing data. For visitor data collected on your agency's site (enquiries, chat transcripts, search queries), your agency is the controller and Hometiko is the processor under a Data Processing Agreement (Art. 28 GDPR).

2. What we process. Account data (name, email, agency details), billing data (handled by our Merchant of Record), usage data (logs, feature usage), and tenant content (listings, leads, media). We do not sell personal data.

3. Legal bases. Contract performance (Art. 6(1)(b)) for operating the platform; legitimate interest (Art. 6(1)(f)) for security and product analytics; consent (Art. 6(1)(a)) for optional cookies and marketing.

4. AI processing. Chat messages and search queries are processed to generate replies and matches. They are stored inside your agency's isolated tenant, are not used to train models across tenants, and can be deleted by the agency at any time.

5. Tenant isolation. Each agency's data lives in a logically isolated tenant. Visitor data captured on one agency's site is never pooled with, shared with, or visible to another agency.

6. Transfers & retention. Data is hosted in the EU. Sub-processors outside the EU/EEA are bound by Standard Contractual Clauses. Account data is kept for the life of the account plus statutory retention periods; tenant data is deleted 30 days after termination.

7. Your rights. Access, rectification, erasure, restriction, portability, and objection (Art. 15–21), plus the right to complain to the data protection supervisory authority of your country of residence. Contact: privacy@hometiko.com.

1. Data controller. Under the Turkish Personal Data Protection Law No. 6698 (“KVKK”), the data controller for Turkish agency accounts is Hometiko, a sole proprietorship registered in Alanya, Antalya. For visitor data on agency websites, the agency acts as veri sorumlusu and Hometiko as veri işleyen (processor).

2. Purposes of processing. Establishing and performing the service contract, operating website/CMS/CRM/AI features, invoicing through the Merchant of Record, security, and fulfilment of legal obligations (Art. 5/2 KVKK).

3. Categories. Identity and contact data, customer transaction data, marketing preferences (with explicit consent), and transaction security data (logs, IP).

4. Transfer abroad. Where data is transferred outside Türkiye (e.g. EU hosting), it is done per Art. 9 KVKK — with explicit consent or adequacy/commitment mechanisms approved by the KVKK Board, and registered in VERBİS where required.

5. Your rights (Art. 11). You may request information on whether your data is processed, its purposes, recipients, correction, deletion, and compensation for unlawful processing. Applications: kvkk@hometiko.com — we respond within 30 days free of charge, and will supply a postal address on request for applications that must be made in writing.

6. E-invoicing & KDV. Invoices for Turkish customers are issued with KDV via the Merchant of Record, compatible with e-Arşiv requirements.

1. Scope. This notice supplements our Privacy Policy for residents of California (CCPA as amended by CPRA) and states with comparable laws (Virginia, Colorado, Connecticut, Utah, Texas).

2. Categories collected. Identifiers (name, email, IP), commercial information (subscription and billing records via our Merchant of Record), internet activity (pages viewed, searches on agency sites), and professional information (agency, role). We collect no sensitive-category data beyond login credentials.

3. No sale, no sharing. We do not sell personal information and do not share it for cross-context behavioral advertising. Therefore no “Do Not Sell or Share” opt-out is required — but we honor Global Privacy Control signals for cookies.

4. Your rights. Right to know, correct, delete, and port your personal information, and to non-discrimination for exercising these rights. Authorized agents may submit requests with proof of authorization.

5. Requests. Email privacy@hometiko.com with the subject “US Privacy Request”. We verify identity via your account email and respond within 45 days (extendable once by 45 days).

6. Service-provider role. For visitor data collected on an agency's website, Hometiko acts as a “service provider”/“processor” to that agency and processes data only per our agreement with them.

1. Strictly necessary. Session, authentication, language preference, and security cookies. Always on — the platform cannot work without them.

2. Functional & analytics (consent-based). Privacy-friendly, first-party analytics measuring page views and feature usage per tenant. No cross-site tracking, no advertising cookies, no third-party ad networks.

3. Agency sites. Each agency website hosted on Hometiko shows its own consent banner where required (EU/UK/Türkiye) and stores consent per visitor. Agencies choose which optional categories to enable.

4. Managing consent. Change your choices anytime via the “Cookie settings” link in the site footer, or through browser controls. Withdrawing consent does not affect prior lawful processing.

Who sells the subscription. Hometiko subscriptions are sold by Paddle.com, 30 Old Bailey, London EC4M 7AJ, United Kingdom, acting as Merchant of Record. Your purchase contract is with Paddle: it takes the payment, charges and remits VAT, KDV or sales tax, and issues the invoice. Paddle's terms are shown at checkout and on your receipt.

Who operates the service. The Hometiko platform is built and operated by a sole trader registered in Alanya, Antalya, Türkiye. Full registration details are held by Paddle as part of its seller verification, and are provided to authorities on request and to customers who need them for their own accounting.

EU online dispute resolution platform: ec.europa.eu/consumers/odr. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
